CRE has been entrusted with the task of monitoring the French wholesale electricity and natural gas markets since 7 December 2006.
The law allows CRE to effectively fulfill this monitoring duty by providing for:
Wide-ranging rights of access to information and sanctions in the event access is refused,
The performance of investigations by authorized investigators,
The guarantee of professional secrecy for all information gathered within the framework of market monitoring,
Referral to the Competition Council in the event an anti-competitive practice is detected.
The operations affected by market monitoring are those that take place on the French market in which a producer, trader or energy supplier is involved regardless of the nationality of the counterparts.
CRE monitors:
Transactions effectively entered into by a producer, trader or supplier,
Proposals made by these wholesale market players,
The technical and economic constraints affecting these players and their proposals and transactions.
CRE’s remit applies to all transactions carried out on the French market regardless of the mode of negotiation:
Bilateral transactions with or without an intermediary,
Transactions on organized markets.
It applies to transactions for physical delivery and transactions for financial settlement when one of the two parties involved in the transaction (purchase or sale) makes a physical delivery on the French market or a financial settlement in connection with the French wholesale price. Cross-border transactions, a single part of which takes place on the French market, are covered by CRE monitoring.
