CRE publishes its decision relating to the implementation of the provisions of Article 14 of Council Regulation n°2022-2576 of 19 December 2022 (so-called “Gas solidarity Regulation”)

Article 14 of Council Regulation 2022-2576 of 19 December 2022 enhancing solidarity through better coordination of gas purchases, reliable price benchmarks and exchanges of gas across borders provides for the application, as of 1st April 2023, of a "use-it-or-lose-it" (UIOLI) mechanism on a monthly basis, which objective is to maximise the use of gas cross-border transmission capacity within the European Union. The regulation provides that the implementation of alternative mechanisms allows for a derogation to the implementation of this UIOLI mechanism. CRE considers that the "use-it-and-buy-it" (UBI) mechanism already applied at all French interconnection points meets the conditions for derogation, and that it is effective in preventing contractual congestion and maximising the availability of firm gas transmission capacity.
